Litigation

Litigation is the process of taking a legal dispute to a court of law for resolution. It is a formal process that involves filing a lawsuit, serving legal documents, conducting discovery, and potentially going to trial. The goal of litigation is for a judge or jury to hear evidence and arguments from both sides and decide on the resolution for the dispute.
Litigation can be used to resolve a wide range of disputes, including contract disputes, personal injury claims, employment disputes, and real estate disputes. It can also be used to seek legal remedies such as monetary damages, injunctions, or declaratory relief.

The litigation process typically follows these steps:

  1. Filing a lawsuit: A person or company that wishes to initiate a legal dispute files a document called a complaint in the appropriate court.
  2. Service of process: The defendant is formally notified of the lawsuit and given an opportunity to respond.
  3. Discovery: Both parties gather evidence and information relevant to the case through the process of discovery.
  4. Motions: Both parties can file motions, which are requests to the court for specific actions or decisions related to the case.
  5. Settlement or trial: The case may be settled out of court before trial, or it may proceed to a trial in front of a judge or jury.
  6. Judgment: The court will issue a judgment, which is a decision on the case, and may also issue an order, which is a specific direction from the court.
